Native Maine Operations, Inc. ("NM") maintains nativeme.com, associated sites and mobile applications (collectively, "nativeme.com", the "Site"). While you should feel free to browse the Site, please understand that your access to and use of the Site is subject to the following terms and conditions ("Terms") and all applicable laws.
Acceptance of these Terms
By accessing and browsing the Site, you accept, without limitation or qualification, these Terms. You acknowledge that any other agreements between you and NM concerning the Site are superseded by these Terms, to the extent they conflict with these Terms.
NM may at any time revise these Terms by updating this posting. You are bound by any such revisions; therefore you should periodically visit this page to review the then current Terms to which you are bound.
Intellectual Property Rights
NM will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
All intellectual property, including trademarks, trade names, logos, service marks, patents, copyrights or trade secret displayed on the Site (collectively, “IP”), including the names Native Maine and Local Flavah, are registered and unregistered intellectual property rights of NM and others. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any IP without the written permission of NM or such third party that may own the IP.
You should assume that everything you see or read on the Site is copyrighted and may not be used without the written permission of NM, except as provided in these Terms or in the text on the Site. Images of people or places displayed on the Site are either the property of, or used with permission by NM. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms or as provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trade mark laws, the laws of privacy and publicity, and communications regulations and statutes.
You may download material displayed on the Site for non-commercial personal use only, provided you also retain all copyright and other proprietary notices contained in the materials or as specified on the Site. You may not, however, distribute, modify, transmit, reuse, re-post, copy, publish, license or use the content of the Site, including the text, images, audio, and video, for public or commercial purposes.
Use of the Site
Your use of or linking to any content on the site, except as provided in these Terms, is strictly prohibited.
NM has not reviewed all of the sites linked to the Site and is not responsible for the content of any off-site pages or any other sites linked to the Site. Your visiting any other off-site pages or other sites is at your own risk.
Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by NM or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, NM is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing, marketing, and selling products using such ideas, concepts, know-how, or techniques.
This Site may contain information on worldwide products and services, not all of which are available in every location. A reference to a product or service on this Site does not imply that such product or service is or will be available in your location. The products referred to on this Site may be subject to different regulatory requirements depending on the country of use. Consequently, visitors may be notified that certain sections of this Site are intended only for certain kinds of expert users or only for audiences in certain countries. You should not construe anything on this Site as a promotion or advertisement for any product or for the use of any product that is not authorized by the laws and regulations of your country of residence.
Exclusions and Limitation of Liability
Whilst NM will use reasonable endeavors to correct any errors or omissions as soon as practicable once they have been brought to our attention, we do not warrant that the Site will be available uninterrupted and in a fully operating condition nor that the information on and provided via the Site will be free from errors or omissions. Access to this Site and its contents may be suspended temporarily and without notice in the case of system failure, necessary maintenance or repair or for reasons beyond NM’s control.
Although NM may from time to time monitor or review discussions, chats, postings, transmissions, message boards, and the like on the Site, NM is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, promotional materials, obscenity, pornography, profanity, danger, privacy disclosure or inaccuracy contained in any information within such locations on the Site. You are prohibited from posting or transmitting any unlawful, promotional, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. NM will fully cooperate with any law enforcement authorities or court order requesting or directing NM to disclose the identity of anyone posting any such information or materials.
